H-2B Housing Standards: What the Law Requires

For many Florida employers, the H-2B Visa program is the engine that keeps their seasonal operations running. However, with the privilege of a legal workforce comes a specific set of responsibilities. One of the most misunderstood—and strictly audited—areas of the program is housing.

While the H-2B program does not always require an employer to provide housing, when you do (or when the nature of the work makes it necessary), the standards are non-negotiable. At H-VISA SOLUTIONS, we help our clients ensure their accommodations are more than just comfortable—they are compliant.

1. When is Housing Required?

Under H-2B regulations, providing housing is generally mandatory if the work is in a location where the Department of Labor (DOL) determines that "prevailing practice" for that industry includes housing, or if the workers cannot reasonably return to their homes at the end of the day.

Even if not strictly required, many Florida employers choose to provide housing to ensure their team arrives on time and has a stable living environment. If you choose to offer housing, you must meet the standards set by the Occupational Safety and Health Administration (OSHA) or the Employment and Training Administration (ETA).

2. The Three Pillars of Housing Compliance

If you are providing housing for your H-2B crew, it must meet these three core criteria:

A. Safety and Health Standards

Accommodations must be structurally sound and weather-tight. This includes:

  • Fire Safety: Working smoke detectors and accessible fire extinguishers.
  • Ventilation & Lighting: Adequate windows for airflow and sufficient electrical lighting in all rooms.
  • Sanitation: Proper sewage disposal and a reliable supply of safe drinking water.

B. Minimum Space Requirements

Overcrowding is a major red flag for DOL auditors.

  • Sleeping Quarters: There must be at least 50 square feet of floor space per person in sleeping rooms.
  • Beds: Each worker must have a separate bed (cot, bed, or bunk) with a clean mattress. Triple-deck bunks are strictly prohibited.

C. Kitchen and Laundry Facilities

If the workers are expected to cook for themselves, the housing must include:

  • Functional stoves and refrigerators.
  • Adequate counter space for food preparation.
  • Easy access to laundry facilities or a regular transportation schedule to a local laundromat.

3. The "Fair Market Value" and Deductions

One of the biggest pitfalls for Florida employers involves charging for housing.

  • The Rule: You cannot profit from the housing. You may only deduct the Fair Market Value or the actual cost of the housing—whichever is less—from the worker's wages.
  • The Disclosure: Any housing deductions must be clearly stated in the initial Job Order. If it isn't in the paperwork, you cannot deduct it from the paycheck later.

Compliance Snapshot: Housing Red Flags

  • Feature: Space / Requirement: 50 sq. ft. per person / Common Violation: Using living rooms as bedrooms.
  • Feature: Water / Requirement: Hot and cold running water / Common Violation: Lack of consistent hot water for showers.
  • Feature: Kitchen / Requirement: 1 stove per 10 occupants / Common Violation: Not enough burners for a full crew.
  • Feature: Safety / Requirement: 2 exits per building / Common Violation: Blocked windows or lack of a second door.

4. Transportation to and from Work

If you provide housing, you are also responsible for the "daily commute."

  • You must provide free transportation between the housing site and the worksite.
  • The vehicles used must be safe, insured, and operated by a licensed driver.

5. Be Ready for the Inspection

The DOL and local health departments have the right to inspect H-2B housing at any time. It is vital to conduct your own "pre-inspection" before the workers arrive. Check for pests, ensure all appliances are working, and verify that the trash collection schedule is set.
